a. that Government Regulation No. 28/2008 concerning the Imposing of Administrative Sanctions in the Form of Fine in Customs field had been enacted on April 11, 2008, and delivered by the State Secretary Minister to the Minister of Finance with a letter of the Deputy of the State Secretary Minister in the field of Legislations No.: B-1633/Setneg/D-4/04/2008 dated April 17, 2008, and therefore the implementation of the provisions can be implemented by the Director General of Customs and Excise accounted for from April 25,2008;
b. that in the framework of maintaining the investment climate so as to stay conducive related to the application of the new provisions regulated in Government Regulation No. 28 Year 2008 concerning the Imposing of Administrative Sanctions in the Form of Fine in Customs field, it is necessary to provide a legal certainty on the imposing of administrative sanction in the form of fine, which had been stipulated within the term as intended in letter a;
c. that based on the consideration as intended in a and b, it is necessary to stipulate a Regulation of the Minister of Finance concerning Technical Directive for the Enforcement of Provisions on the Imposition of Administrative Sanctions in the Form of Fine in Customs Field Based on Government Regulation No. 28/2008;

THE REGULATION OF THE MINISTER OF FINANCE CONCERNING TECHNICAL DIRECTIVE FOR THE ENFORCEMENT OF PROVISIONS ON THE IMPOSITION OF ADMINISTRATIVE SANCTIONS IN THE FORM OF FINE IN CUSTOMS FIELD BASED ON GOVERNMENT REGULATION No. 28/2008 CONCERNING THE IMPOSING OF ADMINISTRATIVE SANCTIONS IN CUSTOMS FIELD
The imposing of administrative sanction in the form of fine in Customs field shall be executed based on provisions regulated in Government Regulation No: 28 of 2008 concerning the Imposing of Administrative Sanctions in the Form of Fine in Customs field.
When this Finance Minister Regulation commences to come to effect, stipulation of administrative sanctions in the form of fine in Customs field, on administrative violations in Customs field, that were issued up to April 24, 2008, is declared as still in effect.
This Regulation of the Minister of Finance commences to become effective from the date of stipulation, having a retroactive power accounted for from April 25, 2008.
For public cognizance, this Regulation of the Minister of Finance shall be announced in the State Gazette of the Republic of Indonesia.
